1. About DutyKit
DutyKit is a trading name of MFPD Studios, an S Corporation registered in Pennsylvania, USA. These Terms of Service govern your use of the DutyKit website and evidence-kit service at dutykit.co.uk. By purchasing a kit or using the service, you agree to these terms. If you do not agree, do not use the service.
2. What DutyKit provides
DutyKit provides a digital evidence-kit service to help NHS-affiliated organisations complete their annual Data Security and Protection Toolkit (DSPT) submission. The service produces three sealed PDF documents: a Missing Evidence Report, an Evidence Checklist, and a Portal Submission Pack. Where your assessment identifies evidence gaps, the kit also includes sector-specific supporting templates — such as a Record of Processing Activities, Incident Response Plan, or Breach Reporting Card — provided as editable starting points for adoption before submission. DutyKit is a self-assessment and document-generation tool. It is not a certification body, an NHS-approved assessor, or a legal or compliance adviser. The final DSPT declaration remains the responsibility of your organisation.
3. Eligibility
You must be aged 18 or over and authorised to act on behalf of the organisation for which you are completing the assessment. By purchasing, you confirm both.
4. Purchasing
Prices are displayed in pounds sterling (GBP). Payment is processed securely via Stripe. Your kit is generated and delivered upon successful payment. A receipt will be sent to the email address provided at checkout.
5. Acceptable use
You may use DutyKit only for lawful purposes and in connection with a genuine DSPT submission for your organisation. You must not:
- Misrepresent the answers you provide during the intake assessment.
- Share, resell, or sublicense a generated kit to third parties for commercial gain.
- Attempt to reverse-engineer, scrape, or copy the DutyKit assessment engine or templates.
- Use the service in any way that violates applicable law or NHS guidelines.
6. Intellectual property
All content, templates, evidence statements, and software comprising the DutyKit service are the intellectual property of MFPD Studios. The PDF output generated for your organisation is licensed to you for internal use only in connection with your DSPT submission.
7. Disclaimer
DutyKit generates evidence documentation based on the answers you provide. Accuracy of the output depends entirely on the accuracy of your inputs. DutyKit makes no warranty that use of the service will result in a successful DSPT submission or a particular standards-met outcome. The service is provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by applicable law.
8. Limitation of liability
To the maximum extent permitted by applicable law, MFPD Studios shall not be liable for any indirect, incidental, special, or consequential loss arising from use of the service. MFPD Studios’ total liability for any claim arising from a purchase shall not exceed the amount paid for that kit. Nothing in these terms excludes liability for fraud or any other liability that cannot be excluded by law.
9. Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania, USA. Any disputes shall be subject to the exclusive jurisdiction of the courts of Pennsylvania.
10. Changes to these terms
DutyKit may update these terms from time to time. The version in force at the time of your purchase applies to that transaction. Material changes will be notified on the website.
